Re. Case 12-cr-120(RJS) United states v Nicolas Epskamp
Dear Chief-Judge Preska,
So far I have not received an answer to my letter of May 12th with above mentioned mark.
I am very curious to learn of your search and/or opinion on the questions I have raised.
Furthermore I would like to add the following:
in August of 2013 I raised the matter of deposing a material witness in this case, in which I am the only remaining defendant. This witness happens to be incarcerated in Germany.
Judge Sullivan granted the request/motion to depose this witness in Germany.
A Letter Rogatory was prepared. Which was completed by mid December 2013.
The Letter was sent to the US State Department on January 9th 2014. From there the routing is by Diplomatic Pouch to the US Embassy in Berlin; to the German State Department; to the Ministry of Justice in Bonn; to the local department in Osnabruck, Niedersachsen.The Letter Rogatory was sent from the US Embassy on April 4th.
It took three (3!) months just to pass on this letter. A real effort. It reached the Justice Ministry in Bonn on April 23. The Court in Niedersachsen had to make arrangements for the two day deposition.
Summer was at hand and so the holiday season. The deposition date is now scheduled for November 19 and 20.
Would the Letter have been passed on in a normal time frame, then the deposition would have been done by now. Or a lot sooner anyway. Which would have brought forward the trial date I am anxiously awaiting.
Maybe you can understand my frustration. I will not call this obstruction of justice immediately but it has the smell of it.
Or it shows complete lack of interest in my position.
